Welcome to Marenco! The terms “we”, “us” and “our” refer to Marenco Azienda Agricola S.S. Soc. Agricola (“Marenco”), Piazza V. Emanuele II, 18 – 15019 Strevi (AL), Italy, VAT no. 02208620068. Marenco operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Marenco is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully, as they contain important information about your rights.
By visiting, interacting with or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not use or access our Services.
Nothing in these Terms limits the rights granted to consumers by Italian Legislative Decree 206/2005 (Consumer Code) or by any other applicable mandatory law.

SECTION 1 - ACCESS, ACCOUNT AND MINIMUM AGE
The sale of wine and alcoholic beverages is restricted to persons aged 18 or over. By placing an order you confirm that you are at least 18 years old. Marenco may cancel orders where there is reasonable doubt about the age of the buyer or recipient, and the courier may ask for proof of identity on delivery.
To use the Services, including accessing or browsing our online store or purchasing any product or service, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You represent and warrant that all information you provide is correct, current and complete.
You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any third party.

SECTION 2 - OUR PRODUCTS
We have made every effort to represent our products and services accurately. However, colors and the appearance of products may differ from how they appear on screen depending on your device and its settings.
The vintage, format and features shown on the product page are those on sale at the time of your order. When the vintage changes, the product page is updated; if a vintage you ordered is no longer available, we will contact you before shipping to offer an alternative or a refund.
We reserve the right to discontinue any product at any time and may limit the quantities of any product offered to any person, geographic area or jurisdiction.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Marenco reserves the right to accept or decline the order. The contract is concluded when Marenco confirms acceptance by email. Payment must be received and processed before the order is accepted. If your order is not accepted, is changed or is cancelled, we will notify you at the email address, billing address and/or phone number provided with the order and refund any amount paid.
Returns, withdrawal and refunds are governed by our Refund Policy.
You confirm that purchases are for personal or household use and not for commercial resale. Trade customers can contact us through our Trade page.

SECTION 4 – PRICES AND BILLING
Prices are shown in euros and, for deliveries within Italy and the European Union, include VAT. Shipping costs are shown at checkout before you confirm your order. For deliveries outside the European Union, any customs duties, excise duties and import taxes are payable by the recipient and are collected by the courier on delivery.
The price charged is the one in effect when the order is placed and is shown in the order confirmation email. Prices, discounts and promotions may change without notice, with no effect on orders already confirmed. Online store prices may differ from those charged at the winery or by third parties. Promotions may be subject to their own terms; in case of conflict, the promotion terms prevail.
You agree to provide current, complete and accurate purchase and payment information and confirm that you are authorized to use the payment method selected.

SECTION 5 - SHIPPING AND DELIVERY
Shipping times, costs and methods are described in our Shipping Policy. Delivery times are indicative. Risk of loss or damage to the products passes to you when you take physical possession of the goods, unless you chose a carrier other than those we offered.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, text, images, graphics, video and audio, as well as their design, selection and arrangement, are owned by Marenco or its licensors and are protected by Italian and international copyright, trademark and intellectual property law.
These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material on the Services without our prior written consent.
Marenco’s names, logos, product and service names, designs and slogans are trademarks of Marenco. You may not use them without our prior written consent. Shopify’s name, logo and trademarks belong to Shopify. All other trademarks on the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be given access to third-party tools as part of the Services, which we do not monitor or control. Your use of such tools is at your discretion and subject to the terms of their providers.
Any new features offered through the Services will be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for the content, accuracy or practices of those websites. Complaints, claims or questions about third-party products and services should be directed to the third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Marenco is powered by Shopify, which enables us to provide the Services to you. All sales made in our store are made directly with Marenco. Shopify is not responsible for any aspect of the sales between you and Marenco.

SECTION 10 - PRIVACY POLICY
All personal data we collect through the Services is processed in accordance with our Privacy Policy and, to the extent applicable to Shopify, the Shopify Privacy Policy. Information you submit through the Services may be transferred to Shopify and to providers that may be located in a country other than your own, in order to provide the Services.

SECTION 11 - FEEDBACK AND REVIEWS
If you send us ideas, suggestions, reviews or other content (“Feedback”), you grant us a free, non-exclusive, perpetual license to use, reproduce and publish it in connection with the Services, including for promotional purposes. You confirm that you hold the necessary rights to such content and that it does not infringe third-party rights or contain unlawful, defamatory or obscene material. We may, without obligation, moderate or remove Feedback that does not comply with these Terms.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping costs, transit times and availability. We reserve the right to correct them. In the event of an obvious pricing error on an order already placed, we will contact you and you may choose to confirm the order at the correct price or cancel it for a full refund.

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or harmful purpose; (b) in breach of national, European or international law; (c) to infringe our intellectual property rights or those of others; (d) to harass, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited promotional material; (g) to impersonate any other person or entity; (h) for any other conduct that restricts others’ use of the Services or may harm Marenco, Shopify or users.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, copy, sell or exploit any part of the Services; (c) collect or track the personal data of others; (d) engage in phishing or similar practices; (e) use robots, spiders, scraping tools or automated tools, including artificial intelligence tools, to access the Services other than as permitted by Section 14; (f) circumvent security or access-restriction measures. We reserve the right to suspend or close your account if you breach these Terms.

SECTION 14 - AGENTS
14.1 This section applies if you use, allow or cause the use of an Agent to access or interact with the Services. “Agent” means any software or service that takes autonomous or semi-autonomous actions on behalf of a person or entity without direct supervision.
14.2 No Agent may access the Services unless it identifies itself and operates in accordance with section 14.4, or if we have asked it to refrain from doing so.
14.3 We may set limits, including through technical measures, on access to and use of the Services by Agents.
14.4 Agents must: (i) declare in all HTTP/HTTPS requests that they are an Agent by including “Agent/[agent name]” in the user-agent string; (ii) not conceal their nature, for example by mimicking human behavior or circumventing CAPTCHAs; (iii) truthfully answer any request intended to determine whether the interaction comes from a human; (iv) not circumvent measures intended to limit or control Agent access.

SECTION 15 - TERMINATION
We may suspend or terminate your access to the Services if you breach these Terms. Orders already confirmed and amounts already due remain valid. Sections that by their nature should survive termination remain in effect.

SECTION 16 - WARRANTIES
Information on the Services is provided for general information purposes. Products sold are covered by the legal guarantee of conformity under the Italian Consumer Code (Art. 128 et seq.). Beyond that guarantee and other mandatory protections, we provide no further warranties on the Services, which are provided as is and as available.

SECTION 17 - LIMITATION OF LIABILITY
To the extent permitted by law, Marenco is not liable for indirect or consequential damages arising from the use of the Services. This limitation does not apply in cases of willful misconduct or gross negligence, nor does it limit the rights granted to consumers by mandatory law.

SECTION 18 - INDEMNIFICATION
You agree to indemnify Marenco against third-party claims arising from your breach of these Terms or of third-party rights, to the extent permitted by law.

SECTION 19 - SEVERABILITY
If any provision of these Terms is held void or unenforceable, it will be enforced to the maximum extent permitted and will not affect the validity of the remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Failure to exercise any right under these Terms does not constitute a waiver of that right. These Terms and the policies referenced herein constitute the entire agreement between you and Marenco regarding the Services.

SECTION 21 - ASSIGNMENT
You may not assign these Terms or any rights under them without our written consent. We may assign these Terms, provided that the assignment does not reduce the protections granted to you.

SECTION 22 - GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law. If you are a consumer resident in the European Union, you retain the benefit of any more favorable protections under the law of your country of residence. Disputes with consumers fall under the jurisdiction of the court of the consumer’s place of residence or domicile; in all other cases, the Court of Alessandria has jurisdiction.

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 24 - CHANGES TO THESE TERMS
You can review the current version of these Terms at any time on this page. We may update these Terms by posting changes on the website; changes apply to orders placed after their publication and not to orders already confirmed. Material changes will be communicated as required by applicable law.

SECTION 25 - SUBSCRIPTIONS

Automatic renewal The quarterly subscription renews automatically every 3 months until cancelled. The amount is charged to the payment method provided at purchase, before each cycle ships.

Cancellation You can cancel your subscription at any time from your account or by writing to visit@marencovini.com. Cancellation must be made at least 7 days before the next renewal to avoid being charged for the following cycle.

Changes Marenco reserves the right to change subscription prices and terms with at least 30 days’ notice by email; in that case you may cancel the subscription without penalty before the changes take effect.

Shipping Shipments follow the store’s standard terms. If a product is unavailable, Marenco may replace it with a selection of equal value, after notifying you by email.

Right of withdrawal For each shipment you may exercise your right of withdrawal within 14 days of receipt, as provided by Art. 52 et seq. of the Italian Consumer Code and our Refund Policy. You may also cancel the subscription before the next renewal without penalty.

SECTION 26 - EN PRIMEUR SALES

Some products, such as Passrì En Primeur, are sold before the wine is bottled and available. At purchase you receive a certificate of ownership; your bottles are reserved and shipped when the wine is ready. Before shipping, we will contact you for the delivery address.

Shipping For deliveries within Italy, shipping is included in the price. For deliveries abroad, shipping costs will be calculated and communicated at the time of dispatch, based on current rates, and must be paid before shipping. For deliveries outside the European Union, Section 4 on duties and taxes also applies.

Right of withdrawal The 14-day withdrawal period starts from receipt of the bottles.
